Steve ‘Commando’ Willis’ alleged stalker has a win in court as she is allowed to submit more evidence in her appeal against an AVO

A former client accused of stalking celebrity personal trainer Steve ‘Commando’ Willis has had a win in court as she is granted permission to submit more evidence in her appeal against an apprehended violence order.

The Biggest Loser star, 44, was granted an AVO against former personal training client Jun ‘Margaret’ Yue in October after he claimed she began crossing the boundaries of a normal client-trainer relationship. 

Ms Yue immediately launched an appeal against the AVO and will now be allowed to submit four text messages as part of her evidence in an attempt to clear her name.

The texts were sent over the holiday period as Ms Yue planned to drop off Christmas presents at the celebrity trainer’s home, The Daily Telegraph reported.

Her barrister Michael Fokkes alleged in the District Court on Monday that the texts showed Mr Willis lied on the stand because he had said the messages caused him ‘irritation and agitation’. 

Mr Willis previously told the court that Ms Yue’s intention to visit to his apartment block to deliver a Christmas present made him feel ‘uncomfortable’. 

He said he told her: ‘I’m spending time with my children, and not constantly looking at my phone’. 

But Mr Fokkes said the reality TV star never said this to his client and the evidence would show ‘absence’ in the text messages, rather than ‘presence’.

‘It does not bare out that the appellant was sending messages demonstrating irritation and agitation,’ Mr Fokkes said.

‘If we can tell he’s telling lies under oath, that goes against his credibility and undermines the whole case.’

Crown prosecutor Amanda-Lee James was in opposition of Ms Yue’s application to submit more evidence. 

Ms James said the evidence should have been raised in the local court, adding that her client is ‘in need of protection’ and ‘not dishonest’.  

Mr Fokkes will be allowed to use the new evidence in Ms Yue’s appeal after it was approved by Judge Dina Yehia.

Ms Yehia said the material is not extensive and can be dealt with without any prejudice. 

Both Ms Yue and Mr Willis were not in court on Monday. Their case returns on May 10.  

Mr Willis was granted an AVO in Sydney’s Downing Centre Local Court in October.

The order prevents Ms Yue from assaulting, stalking or harassing him, contacting him in any way except via a lawyer, trying to find him or going within 200m of his home or places of work for two years.

The pair spent a lot of time together, with Commando training Ms Yue more than 120 times and about three to four times a week from March 2019 to May 2020.
