A landlord and her husband have brazenly pitched a tent in the backyard of their tenant’s home on Christmas Day and started living there.

Nicky and William and their three young children had been living in the rented home in Yamba on the New South Wales north coast for two months when their landlord Pascale Hubert suddenly informed them she would be moving onto the property.

‘Dear Nicky and William, I am the owner. As of tonight I will be occupying the rear yard,’ Ms Hubert messaged the couple.

Ms Hubert says she is justified in taking over the back of the block as the tenants do not have access to the $560-a-week backyard under their lease agreement. 

The rental contract includes the phrase ‘rear yard is not included’.

Nicky said police have told her they are powerless to force the landlords off the property. 

‘It’s day 11 of them living in the backyard. It’s completely bizarre to everybody we tell. Police and real estate don’t know what to do,’ she told A Current Affair.  

‘Our children are terrified, they keep asking, ‘who are they?’ and we can’t give them any answers.’

The landlord’s husband has already had a heated confrontation with the couple – ordering them to move their car so he and his wife could access the back of the four-bedroom, two bathroom property.

‘Listen here s*** for brains, I’ve given you a warning, move that frigging car now you are in big s***,’ he said in one video filmed by the tenants. 

But tenant advocates argue the landlord is trespassing by using the side of the house to get to the backyard.

‘It could be that the landlord is trespassing whenever they go across that driveway area because they are entering into a place that they’ve given someone else procession,’ Tenants Union of NSW CEO Leo Patterson Ross said.
