Police performing an inspection on Friday of the subway’s A/C/E line at 42nd Street-Port Authority Bus Terminal Station spotted the suspect Friday afternoon as he was charging his cellphone with his unloaded rifle sticking out of his backpack on the ground.

Police also found ammunition and a gas mask in his back pack, NBC 4 reported.

Officers approached the man and questioned his intentions and the suspect claimed the gun was legally owned.
